Terms and Conditions Commercial Turf Fertilization

1. Acceptance of Terms

By engaging Commercial Turf Fertilization (referred to as “Company,” “we,” “us,” or “our”) for lawn fertilization, turf management, or related services, you (the “Client”) agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and the Company. If you do not agree, do not proceed with our services.

2. Services Provided

We provide commercial lawn fertilization, soil amendment, weed control, and related turf management services. All services are performed according to industry standards, product labels, and the specific proposal or agreement executed with the Client. Results can vary based on weather, soil conditions, application timing, and other environmental factors beyond our control.

3. Client Responsibilities

• Provide safe and clear access to the property on scheduled service dates.
• Inform us of any known hazards, sensitive plants, pets, or irrigation systems.
• Follow all post-application instructions (e.g., watering guidelines, pet restrictions, re-entry times).
• Ensure no alterations to the treated areas that could affect results or safety without our prior notice.

4. Payment Terms

• Payment is due as specified in the proposal or invoice.
• Late payments may incur fees and may result in suspension of services.
• Prices are subject to change with notice.

5. Limitation of Liability and Release

IMPORTANT – PLEASE READ CAREFULLY

TO THE FULLEST EXTENT PERMITTED BY LAW, THE CLIENT HEREBY RELEASES AND HOLDS HARMLESS Commercial Turf Fertilization, its owners, officers, employees, agents, contractors, and affiliates (collectively the “Released Parties”) FROM ANY AND ALL LIABILITY, CLAIMS, DAMAGES, LOSSES, OR EXPENSES (INCLUDING ATTORNEY FEES) ARISING OUT OF OR RELATED TO:

• Damage to lawns, plants, trees, shrubs, flowers, or other vegetation.
• Damage to soil, water features, irrigation systems, or hardscapes.
• Environmental impacts, runoff, or drift.
• Injury to persons, pets, or livestock.
• Any indirect, incidental, consequential, or punitive damages.
• Failure of the turf to meet Client expectations or achieve specific results.

We do not guarantee uniform results, complete weed elimination, or specific growth outcomes. Turf response depends on many variables outside our control (weather, prior conditions, pests, disease, etc.).

Our total liability under any claim shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.

6. No Warranties

We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. No oral or written statements create any warranty.

7. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, or liabilities caused by your negligence, failure to follow instructions, or misuse of the property after application.

8. Governing Law

These Terms shall be governed by the laws of the State of [Insert Your State], without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in [Insert County/City], [State].

9. Changes to Terms
